A Legal Examination of Illegal Searches and Seizures on Criminal Investigation in Nigeria

Abstract
ABSTRACT The study examined legal examination of illegal searches and seizures on criminal investigation in Nigeria. The objectives of this study is to analyze the legal frameworks governing searches and seizures in Nigeria, examine the impact of illegal searches and seizures on the integrity of criminal investigations and judicial processes in Nigeria, identify the factors contributing to the prevalence of illegal searches and seizures in Nigeria and assess the role of the judiciary in addressing cases of illegal searches and seizures and ensuring the protection of citizens’ rights. It concluded that the significant impact of illegal searches and seizures on criminal investigations in Nigeria, revealing how such practices undermine the integrity of the criminal justice system Based on the findings, it was recommended that Law enforcement agencies should be required to obtain judicial approval for every search through a valid search warrant issued by a court. This ensures that searches are conducted based on reasonable suspicion and adhere to the principle of due process. Victims of illegal searches and seizures should be entitled to effective remedies for the violation of their rights. This includes the possibility of seeking compensation for damages caused by unlawful actions, as well as the exclusion of illegally obtained evidence in criminal trials. Legislative amendments should be made to the Evidence Act to stipulate the inadmissibility of evidence obtained through unlawful searches, further emphasizing the importance of respecting individual rights..
