An Analysis of the Stages of Acquiring Ahliyatul Ada Alkamila

Abstract

In Islamic law, before a person can be a competent legal party to a contract must acquire Ahliyyah Ada-AlKamila'. This research work using doctrinal research methodology analysed the stages and juristic opinions on how a person attains it. The research work work found that some jurist lay emphasis on age. By this a person becomes competent party to a contract of he reached between 15 to 18 for both male and female. On the other hand some jurists lay emphasis on physical appearance which are commencement of menstruation, pubic hair, for female and pubic hair, wet dream for males. The research work recommend that Ahliyyah Ada-Al-Kamila should be determined by fact, that is whichever is proved should be adopted, either by age or by the physical appearance.
